If this guy was alone in his truck, then I think the police have gone too far. How ridiculous!

TORONTO (Reuters) – A Canadian truck driver has been fined for smoking in his vehicle because it is considered his workplace, a police spokeswoman said on Friday.

A police officer saw the 48-year-old trucker driving on a highway in southwestern Ontario with a cigarette in his mouth on Wednesday, and gave him a C$305 ($290) ticket.

The Smoke-Free Ontario Act, adopted in 2006, prohibits smoking in an enclosed workplace or enclosed public area, and that extends to work vehicles, said Constable Shawna Coulter of the Ontario Provincial Police in Essex County.

"We enforce the legislation and this truck driver was in violation of that," she said.

Police should have better things to do. Too bad there are too many Barney Fife's out there. I will never forget being stopped on an interstate highway in West Texas. I wasn't speeding and couldn't figure out why the trooper stopped me. Sixty dollar ticket for no seat belt was the answer.

Who gets to decide which laws are stupid? If a large majority find a law stupid there is a mechanisms to get a law changed.

On the other hand, Andy Taylor was an excellent sheriff. Very good judgement that man had.

They were a good combination. The over enthusiastic Barney was counterbalanced with Andy's calm, cool judgment. Too bad this Canadian cop did not have an Andy Taylor for a partner.

There is such a thing as "officer discretion" that gives an officer some leeway in deciding whether to issue a ticket or make an arrest in certain cases. This is one of those situations when the officer should have decided it was in the interest of public good just to let the guy slide.

The article neglected to mention if the trucker was an owner operator, also if there were any other passengers.

I am not sure if the driver was the owner of the truck or not. I believe he was alone in the truck according to this site http://www.abovetopsecret.com/forum/thread508887/pg1

Another article states, "The driver, whose name was not immediately released, could have good reason to fight the ticket in court, said Doug Switzer, vice-president of the Ontario Trucking Association.

The provincial law ought not apply in the case of federally regulated trucking companies that operate in other provinces or the United States, Switzer said -- nor should it be brought to bear on truckers who own and operate their own rigs and work alone."
